1. Who We Are

WeKare360 is a product of WeKare Inc., a Texas corporation. The app is developed and distributed by Celeix Digital LLC, also a Texas entity. Both entities operate collectively as "WeKare." Contact: info@wekare360.com

2. Acceptance of Terms

By using WeKare360, you agree to these Terms. These Terms incorporate our Privacy Policy by reference.

3. Eligibility

You must be at least 18 years of age. The app is not directed at children under 13.

4. Description of Service

WeKare360 is a voice-first AI life and healthcare assistant (Care, Smile, Mind, Life) for personal, non-commercial use. WeKare360 is NOT a medical provider and does not constitute medical advice.

5. Recording and Consent

You are solely responsible for complying with all applicable federal, state, and local recording laws, including the Federal Wiretap Act. All-party consent is required in the following states: CA, CT, DE, FL, IL, MD, MA, MT, NV, NH, PA, WA. WeKare is not responsible for verifying your consent compliance.

6. AI Processing

Recordings are processed via ElevenLabs (transcription) and OpenAI (summarization). ElevenLabs does not permanently retain audio. OpenAI does not use API data for model training.

7. User Accounts

You are responsible for all activity under your account. Notify us immediately of any unauthorized access at info@wekare360.com.

• Coordinated Care — $9.99/mo
• Complete Care — $19.99/mo

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.

9. SMS Messaging

By registering, you consent to receive SMS messages from WeKare (OTPs, alerts, reminders). Reply STOP to opt out. Reply HELP for assistance. Message and data rates may apply. Consent to receive SMS is not a condition of purchase.

10. Prohibited Uses

You may not use WeKare360 for:

• Unlawful recording of third parties
• Impersonation of any person or entity
• Unauthorized access to our systems
• Reverse engineering or decompiling the app
• Commercial use without prior written authorization

12. Limitation of Liability

Our aggregate liability is capped at the amount you paid in the prior 12 months or $50, whichever is greater. We are not liable for indirect, incidental, or consequential damages.

13. Governing Law

These Terms are governed by the laws of the State of Texas. Exclusive jurisdiction lies in Nueces County, Texas.

14. Changes to These Terms

Material changes will be communicated via an Effective Date update and in-app notification. Continued use after changes constitutes acceptance.
